Terms of Service

1. Acceptance of Terms

By accessing or using NexHost services, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Account Registration

You must provide accurate and complete registration information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

3. Service Description

NexHost provides cloud hosting infrastructure including virtual private servers, managed databases, content delivery, DDoS protection, and game server hosting. Service specifications, features, and availability are as described on our website and may be updated from time to time.

4. Acceptable Use Policy

You agree not to use our services for: illegal activities, distributing malware, sending spam, cryptocurrency mining without authorization, hosting content that infringes intellectual property rights, or any activity that threatens the security or performance of our infrastructure.

5. Payment & Billing

Services are billed monthly or annually as selected. All fees are non-refundable except as required by law or as specified in our SLA. We reserve the right to change pricing with 30 days notice. Accounts with overdue payments may be suspended after 14 days.

6. Uptime Guarantee

We guarantee 99.99% uptime for all services as detailed in our Service Level Agreement. Service credits are available for qualifying downtime events as specified in the SLA.

7. Limitation of Liability

NexHost's total liability shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, loss of data, or loss of profits.

8. Termination

Either party may terminate services with 30 days written notice. We may immediately terminate accounts that violate our Acceptable Use Policy. Upon termination, you have 30 days to export your data before it is permanently deleted.

9. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes shall be resolved through binding arbitration in San Francisco, CA under the rules of the American Arbitration Association.

10. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email and dashboard notification at least 30 days before taking effect. Continued use of our services constitutes acceptance of modified terms.
